New biodiesel plants (not in operation before July 1, 2011) with capacity exceeding one million gallons may receive up to $1.5 million annually in production incentives at five cents per gallon marketed to distributors or wholesalers.

Existing biodiesel plants (in operation before July 1, 2011) are eligible for incentive payments on increased production of up to the lesser of ten million gallons or fifty percent of production capacity during any twelve-month period beginning after July 31, 2011.

Office of renewable energy and energy efficiency administers the program and may not distribute more than $1.5 million per facility annually or create a negative fund balance.

Eligible facilities may not receive cumulative payments exceeding $7.5 million or for longer than five years, with ownership changes not resetting these limits.

Creates the biodiesel production incentive fund in the state treasury with continuing appropriation to the office of renewable energy and energy efficiency for program administration.
