Amends section 54-59-02 to add "Except as provided in section 54-59-05" language, clarifying that the Information Technology Department's prohibition on competing with private telecommunications companies has specified exceptions.

Modifies section 54-59-05, subsection 13 to explicitly prohibit the Information Technology Department from providing wide area network services to private, charitable, or nonprofit entities, with two exceptions.

Allows the department to continue providing wide area network services to private, charitable, and nonprofit entities that were already receiving such services from the department on January 1, 2003.

Permits the department to connect to a wide area network service for health information exchange in accordance with federal requirements for health information exchange.
