Amends North Dakota Century Code section 50-24.1-02.3 to exclude pre-need funeral service contracts, prepayments, or deposits totaling $6,000 or less from medical assistance eligibility determinations.

Allows applicants or recipients to designate prepayments or deposits for their own funeral or burial expenses by providing funds specifically designated for those costs.

Permits applicants or recipients to designate all or a portion of the $3,000 asset limitation for funeral pre-need contracts, prepayments, or deposits, with interest or earnings in the fund also excluded as available resources.

Requires any unused funds in a designated pre-need funeral service contract, prepayment, or deposit to be returned to the medical assistance recipient's estate and subjects such funds to recovery by the department.

Prohibits claims for payment of funeral expenses against a deceased medical assistance recipient's estate unless designated funeral funds total less than $6,000.
