State agencies may grant utility, transmission, road, transportation, and waterway easements on state-owned property administered for state institutions, but are prohibited from granting conservation easements.

Easement duration is limited to a maximum of 40 years.

Institutions governed by the State Board of Higher Education may execute easements through their institution president or delegated officer, rather than requiring execution by the governor and secretary of state.

Easement proceeds from property subject to devises, legacies, bequests, or gifts must follow provisions of sections 1-08-02 and 1-08-04.

Easement proceeds from other property must be deposited in the institution's special operating fund or, if no such fund exists, in the state general fund treasury.
