SB 2141 Summary

• Creates new authority for presiding judges of judicial districts to authorize correctional facility administrators to grant performance-based sentence reductions to inmates based on established criteria.

• Limits sentence reductions for offenders in correctional facilities to a maximum of one day reduction per six days served, except offenders sentenced under section 12.1-32-09.1 are ineligible.

• Amends existing law to allow the Department of Corrections and Rehabilitation to credit eligible offenders with up to five days of good time per month, with performance criteria including treatment program participation, education programs, and good work performance.

• Excludes sentence reductions for time spent in custody before sentencing, supervised probation time, or sentences of six months or less for Department of Corrections offenders and thirty days or less for local correctional facilities.

• Passed Senate 45-1 and House 86-0 during the 2011 Regular Session.
