Increases maximum collection fees or costs recoverable for dishonored checks from $30 to $35 per instrument for both insufficient funds checks and no-account/closed-account instruments.

Extends the deadline for state's attorney acceptance of dishonored check complaints from 120 days to 120 days after the drawer receives notice (clarifies timing for no-account instruments under section 6-08-16.2).

Adds fraud exception: if state's attorney or check holder determines the issuer is a fraud victim rather than the actual violator, the holder's agent or representative must provide written notice and may not collect fees or costs.

Requires collection agencies to reimburse original check holders for additional charges assessed by depository banks, not to exceed $2, if recovered by the collection agency.

Authorizes courts to order individuals convicted under this section to undergo evaluation by a licensed gaming, alcohol, or drug addiction counselor.
