Establishes a surface rights board appointed by the governor with at least three members to mediate disputes over oil and gas exploration and production damages.

Requires operators to pay compensation for surface rights and damages; either party may apply to the board for determination if they disagree on required rights, compensation amount, or lease/agreement interpretation.

Board shall consider factors including land value, loss of use, area damaged, increased costs, nuisance/inconvenience, severance effects, and cumulative impacts when determining compensation.

Allows board to award legal, appraisal, and other expenses to owners or occupants if operator's pre-hearing compensation offer was less than 90 percent of board's determination.

Amends section 38-11.1-09 to redirect compensation disputes to the surface rights board process instead of court litigation.
