Law enforcement officers may take an individual into custody without a warrant if they have reasonable cause to believe the individual violated a court order requiring participation in the twenty-four seven sobriety program authorized in sections 54-12-27 through 54-12-31.

An individual taken into custody under this provision may not be released on bail or personal recognizance unless they make a personal appearance before a magistrate.

Adds a new subsection to section 29-06-15 of the North Dakota Century Code.

Declared an emergency measure by the legislature.
