Modular residential or commercial structure manufacturers built in factories must contract with a third-party inspector approved by the Division of Community Services to ensure compliance with all applicable building, electrical, fire, and plumbing codes and standards.

The Department of Commerce shall adopt rules for certifying third-party inspectors and establishing procedures for conducting modular structure inspections.

When a manufacturer contracts with a certified third-party inspector to monitor code compliance, no further inspections by state or local building, electrical, fire, or plumbing inspectors may be required during the factory manufacturing process.

This requirement does not apply to factories manufacturing fewer than 60 residential or commercial structures per year.
