Legislative assembly declares that present use and disposal of coal combustion residues is acceptable in North Dakota.

Current state regulations allow beneficial use of coal combustion residues in concrete, construction applications, and other innovative uses.

Coal combustion residues may be safely disposed of without being regulated as hazardous waste under present state law.

State may seek primacy of any federal program if future federal laws or regulations are adopted pertaining to coal combustion residue use and disposal.
