Changes notification method from "registered mail" to "certified mail" for water resource board notices regarding noncomplying dams, dikes, and drains.

Establishes a two-tier appeal process allowing aggrieved parties to first appeal water resource board decisions to the state engineer within 30 days, then appeal state engineer decisions to district court under chapter 28-32.

Authorizes the state engineer to conduct independent investigations and choose to notify landowners, return matters to the board, or forward complaints to the state's attorney if the board fails to act within 120 days.

Provides timeframes for removal or closure: landowners have minimum 15 days from board notice and minimum 30 days from state engineer notice to comply before the state takes action and assesses costs against the property.

Applies authority to dams and dikes constructed after August 1, 1999, and drainage systems constructed after January 1, 1987.
