Division of homeland security serves as central information dissemination point and repository for initial notification information on spills and discharges of hazardous chemicals, oil, gas, and salt water in North Dakota.

Division shall develop processes to ensure proper state and federal agencies with oversight responsibilities are promptly notified of spills and discharges.

Division shall provide notice to local emergency management officials within a timeframe consistent with the level of emergency.

Owners, operators, and responsible parties must report all spills or discharges to the appropriate state agency with reporting party name, phone number, address, date, time, location, containment status, waterways involved, and immediate potential threat.

If a release occurs or travels off-site from a facility, the owner and operator must notify the surface owner within a reasonable time, and state agencies receiving direct reports must provide information to the division within a timeframe consistent with potential response level needed.
