State department of health shall establish an immunization information system to receive and retain data on all adult and childhood immunizations and other designated information.

Health care providers administering adult or childhood immunizations must report patient identifying information, immunization type, and other required data to the department within four weeks using electronic media in department-specified format.

Health care providers failing to submit immunization reports within four weeks may not order or receive vaccines from the North Dakota immunization program until all reports are submitted, and the department shall report the failure to the provider's occupational licensing entity.

Health care providers, schools, early childhood facilities, postsecondary institutions, boards of health, district health units, and the state health officer may exchange immunization data with one another limited to the date and type of immunization administered, regardless of immunization date.

Pharmacy personnel may administer immunizations and vaccinations to individuals at least eleven years of age and influenza vaccines to individuals at least five years of age upon physician order or written protocol, with reporting requirements to the state immunization information system.
