HB 1183 Summary

• Prohibits North Dakota state and local governmental entities, including law enforcement, from investigating, enforcing, or prosecuting federal firearms laws enacted after December 31, 2012.

• Prevents state entities from assisting the federal government with such investigations or prosecutions, providing resources or information, accepting federal deputation for these purposes, or using state resources for prohibited activities.

• Forbids state entities from jailing, confining, imprisoning, or confiscating firearms solely due to violations of post-2012 federal firearms laws, except when a firearm is evidence of an unrelated crime.

• Prohibits state entities from adopting state or local laws identical or similar to post-2012 federal firearms laws for enforcement purposes.

• Allows aggrieved parties to bring civil actions for relief against governmental entities (not individual officers) for violations, with the Act applying retroactively to firearms laws in effect as of January 1, 2013.
