Nonresidents stopped for speeding violations (section 39-09-02) who are registered vehicle owners and gainfully employed in North Dakota must pay the higher of either North Dakota's standard fee or their home state's highest speed violation fee.

The highway patrol superintendent shall compile and update every two years a schedule of the highest fees, fines, or bonds for speed violations in other states and distribute it to police officers.

If the home state's highest fee exceeds North Dakota's fee, the difference is assessed as a special fee and deposited in the state treasury.

Special fees collected are distributed monthly to the county sheriff (for county police citations) or the highway patrol operating fund (for highway patrol citations).

All fees collected under this section are appropriated on a continuing basis for distribution as specified.
