Creates chapter 23-20.6 of the North Dakota Century Code to regulate thorium refineries and molten fluid fueled reactor facilities for intrastate use only.

Defines "molten fluid fueled reactor" as any reactor based on molten fluid fueled design including thorium-based fuels, and "thorium refinery" as operations removing thorium from rare earth element and other tailings.

Authorizes the state department of health to issue permits for thorium refineries and molten fluid fueled reactor facilities that remain within North Dakota's borders if compliant with all applicable state laws.

Declares that the EPA and Nuclear Regulatory Commission lack authority to deny permits for these operations because their products do not travel in interstate commerce.

Limits application to operations requiring permits under the Atomic Energy Act of 1954 or Energy Reorganization Act of 1974, and directs the department to request the Nuclear Regulatory Commission to formulate state or federal regulations for molten fluid fueled reactors.
