School boards cannot enter agreements with building authorities or other entities under IRS Revenue Ruling 63-20 for property acquisition, improvements, or construction costing $4 million or more unless approved by majority vote of qualified school district electors at a regular or special election.

The voter approval requirement applies when an election would be required if the school district directly undertook the project itself through bond issuance.

School boards cannot enter building authority agreements for construction, purchase, repair, improvement, modernization, or renovation of buildings or facilities without superintendent of public instruction approval when such approval would be required if the district undertook the project directly.

The superintendent of public instruction approval process follows procedures outlined in section 15.1-36-01 of the North Dakota Century Code.
