HB 1301 Summary

• Amends student placement residency determination rules to clarify that a student's school district of residence is determined based on where the custodial parent or legal guardian resides at the time of court-ordered, social agency, or voluntary placement in foster care or child care facilities.

• Requires placing agencies to notify school districts of student placements within five working days for court orders or emergencies, or at least ten working days prior to other placements.

• Establishes state payment responsibility for tuition and tutoring charges when a student's custodial parent establishes residency outside North Dakota, parental rights are terminated, the student has no custodial parent, or reasonable efforts to locate the parent have failed.

• Modifies boarding care cost reimbursement from 80 percent for all placements to 80 percent only for placements at facilities located outside the student's school district that provide special education services unavailable within the district.

• Becomes effective July 1, 2013, and is declared an emergency measure.
