Petitions submitted to the secretary of state are considered filed immediately and cannot be returned to the sponsoring committee for continued circulation or resubmission at a later time.

Electors cannot remove their names from petitions after the petitions have been submitted to and received by the secretary of state or appropriate filing officer.

Recall petitions under the North Dakota Constitution must be gathered within one year from the date the secretary of state approves the petition for circulation.

Recall petitions under section 44-08-21 must be gathered within ninety days from the date of secretary of state approval and submitted to the appropriate filing officer.

Recall petition requests must be presented on individual notarized signature forms that include the recall identification, committee member's printed name, signature, address, and notarization, with filed forms required to be originals.
