Employers may pay annual workers' compensation premiums in installments with interest charged at the Bank of North Dakota base rate plus 2.5 percent, with a minimum of 6 percent per annum.

Premiums are in default one month from the due date; the organization may declare employers uninsured after 45 days past due and can make the entire remaining balance immediately due.

Uninsured employers face penalties of 25 percent of premiums for the most recent noncompliance year, plus an additional 5 percent for each prior year (up to six years), plus a $2,000 penalty per premium period.

Workers' compensation claims are exempt from creditor claims except for child support, unemployment benefit reimbursement, and organization claims for clerical errors, fraud, overpayments, or premiums and penalties.

Volunteer firefighters, emergency volunteers, volunteer health practitioners, and community response team members' benefits and premium assessments are determined based on reasonable wages or fees for their industry class.
