Possession of a firearm at a public gathering is a class B misdemeanor, with "public gathering" defined to include athletic or sporting events, schools or school functions, churches or church functions, political rallies or functions, musical concerts, and publicly owned parks where hunting is prohibited and publicly owned or operated buildings, but excluding state or federal parks.

Law enforcement officers, armed forces members on duty, organized sport shooting competitors, gun and antique shows, blank cartridge firearm users at sporting or theatrical events, firearms in temporary residences or motor vehicles, hunter safety class participants and instructors, and on-duty private security personnel are exempt from the prohibition.

Municipal court judges, district court judges, state attorney general staff members, and retired North Dakota law enforcement officers are exempt if they maintain firearms proficiency standards set by the peace officer standards and training board and obtain a certificate of compliance from a local law enforcement agency.

Political subdivisions may enact ordinances less restrictive than this section, which supersede state law within their jurisdiction.
