Amends North Dakota Century Code section 23-37-17 to modify penalty fees for owners or operators of existing tanks discovered at locations previously registered with the fund before July 1, 2007, changing the penalty from $75 to an additional $25 for each aboveground tank and from $125 to an additional $25 for each underground tank.

Requires owners or operators of existing tanks at locations not previously registered with the fund to provide a phase two environmental study by a qualified firm and perform a tank integrity test, subject to commissioner review and approval.

Allows applicants whose applications are rejected to reapply after remediating the site and replacing the leaking tank.

Exempts new tank installations at new sites or at existing sites with previously registered tanks from environmental study and integrity test requirements if only standard registration fees are paid.

Passed the Senate 45-1 and the House 93-0 during the Sixty-third Legislative Assembly regular session in 2013.
