Amends North Dakota Century Code section 47-19-41 to modify the recording statute for real estate conveyances.

Unrecorded conveyances of real estate are void against any subsequent purchaser in good faith who records their conveyance first, regardless of the deed form used.

Recorded instruments are deemed valid legal records even if not entitled to be recorded, and courts cannot refuse to recognize recorded instruments on that basis.

Holders of unrecorded conveyances cannot challenge the good faith of the first recording party unless they can establish the recording party had actual knowledge of the unrecorded conveyance.

Senate passed 46-0 (1 absent) and House passed 93-0 (1 absent) during the 2013 regular session.
