Creates a new section to chapter 23-12 of the North Dakota Century Code establishing voluntary participation in the state health information exchange created under chapter 54-59.

Allows individuals to opt-out of the health information organization by providing notice, preventing their health information from being accessed by insurers, government health plans, or healthcare providers other than the provider who created the records.

Permits individuals to choose between full opt-out or conditional opt-out, where information access is limited to healthcare providers during medical emergencies.

Allows individuals to change their opt-out decision at any time by providing written notice to the health information organization, and does not prevent disclosures required by law.

Prohibits healthcare providers, health insurers, and government health plans from withholding coverage, care, or denying health insurance benefits based solely on an individual's choice to participate in or opt-out of the health information organization.
