• Imposes a 2 percent prepaid wireless emergency 911 fee on gross receipts from retail sales of prepaid wireless services in North Dakota, collected by sellers from consumers.

• Prepaid wireless service is exempted from the existing monthly emergency 911 fee imposed on other assessed communications services under section 57-40.6-02.

• Creates a prepaid wireless emergency 911 fee fund to be administered by the state treasurer and distributed quarterly to a joint powers entity for implementing emergency communications systems for political subdivisions.

• Provides liability protections for public agencies, service providers, and sellers from civil damages except in cases of willful and wanton misconduct or gross negligence related to emergency services systems.

• Requires prepaid wireless service providers or sellers to provide call location information to law enforcement agencies and public safety answering points upon request in emergency situations; effective for taxable periods beginning after December 31, 2013.
