Senate Bill No. 2291 - Net Metering Summary

• All electricity distributors in North Dakota, including investor-owned companies, electric cooperatives, and municipal providers, must provide net metering services.

• Qualifying facilities must have a design capacity between 40 and 100 kilowatts, with interconnection fees capped at $500.

• Distributors must pay qualifying facilities for excess energy credits at 50 percent of retail value before January 1, 2015, 75 percent between January 1, 2015 and December 31, 2016, and 100 percent of retail value after December 31, 2016.

• Utilities demonstrating significant rate impacts can remain at the 50 percent payment level when transitioning from 50 to 75 percent or from 75 to 100 percent of retail value.

• The Public Service Commission shall adopt rules implementing net energy billing where facility output reverses the electric meter measuring sales from the distributor.
