Exempts land used for disposal of technologically enhanced naturally occurring radioactive material from custody provisions in state law.

Removes the requirement for cross-examination in radioactive material licensing proceedings and restructures procedural requirements for department action.

Increases civil penalties for violations from a maximum of $10,000 per day to $12,500 per day per violation.

Elevates criminal penalties for willful violations from class A misdemeanor to class C felony, and establishes class C felony penalties for false statements and falsification of monitoring records.

Repeals section 23-20.1-09.1 relating to confidentiality of radioactive material records.
