State board of pharmacy may adopt rules to establish procedures and methods for implementing the prescription drug monitoring program.

Each professional licensing board responsible for licensing prescribers and dispensers of controlled substances must adopt rules requiring their licensees to utilize the prescription drug monitoring program.

Professional licensing boards must consult with the state board of pharmacy, other boards, and the advisory council when drafting rules to maximize uniformity across professions.

Boards may conduct joint rulemaking proceedings under chapter 28-32 to implement required rules for the prescription drug monitoring program.

A person, including a vendor, who uses or discloses prescription drug monitoring information in violation of this chapter is subject to penalties under section 12.1-13-01.
