• Private employers may withhold payment for accrued paid time off when an employee voluntarily separates if the employer provided written notice at hiring, the employee worked less than one year, and gave less than five days' notice.

• Private employers may withhold payment for paid time off that was awarded but not yet earned by the employee if written notice of this limitation was provided before awarding the paid time off.

• Employees may report violations to the labor commissioner, who must investigate if the report is made within 30 days of the violation or may investigate if made more than 30 days after.

• The Act applies to separations from employment occurring on or after its effective date.

• Passed with bipartisan support: 92-0 in the House and 46-0 in the Senate.
