HB1222 Summary

• Any new smartphone manufactured, sold, or purchased in North Dakota must be equipped with preloaded antitheft functionality or be capable of downloading it at no cost to purchasers.

• "Smartphone" is defined as a cellular phone or mobile device with a smartphone operating system, advanced computing capability, network connectivity, and ability to operate on long-term evolution networks; excludes feature phones, laptops, tablets, and e-readers.

• Wireless telecommunications equipment manufacturers, operating systems providers, and wireless service providers must submit a report to legislative management by July 31, 2015, describing the baseline antitheft tool functions they will use to comply with this Act.

• The report must describe technology or functions included to ensure the baseline antitheft tool is easily operable by individuals with disabilities.
