Individuals at least 18 years of age who are current members of the active uniformed services of the United States may purchase and consume alcoholic beverages at any premises licensed to sell alcoholic beverages in North Dakota.

Existing prohibitions on individuals under 21 years of age manufacturing, purchasing, consuming, or possessing alcoholic beverages remain in effect, except for the military exception.

Violations of the underage drinking law constitute a class B misdemeanor, with violators required to complete alcohol and drug education.

Courts may refer violators to outpatient addiction facilities licensed by the department of human services for evaluation and counseling or treatment.

Individuals under 21 are immune from criminal prosecution if they contact law enforcement or emergency services to report another person needing medical assistance due to alcohol consumption, with a maximum of five individuals receiving immunity per occurrence.
