HB 1229 Summary

• Prohibits unlicensed persons from advertising to contract for electrical services unless they are licensed or associated with a class B or master electrician, or intend to contract services with a licensed electrical contractor.

• Imposes penalties for violations: class B misdemeanor (first offense, maximum $100 fine) and class A misdemeanor (second offense, maximum $1,000 fine; third offense, up to $1,000 fine or 30 days imprisonment).

• Requires master electricians and class B electricians to deposit undertakings ($5,000 and $4,000 respectively) and deposits ($50 and $40 respectively) with the board before contracting for electrical installations.

• Establishes a special fund administered by the board, funded by deposits, to complete installations abandoned by electricians; effective July 1, 2016, remaining funds shall be used to educate electricians about electrical code requirements.

• Repeals the special fund section of North Dakota Century Code Section 43-09-14 effective August 1, 2017.
