Any person who sells cattle in North Dakota must pay an assessment equal to the greater of fifty cents per animal or the federal law amount, plus an additional one dollar per animal assessment.

Assessment exemptions apply to persons whose only share in sale proceeds is a commission or fee, and to persons who acquire cattle solely to facilitate transfer to a third party and resell within ten days with prior owner assessments collected.

Willfully providing false or misleading information to the commission regarding assessments is a class B misdemeanor.

Producers may request refunds of assessments within sixty days of sale and must submit completed refund applications within ninety days, with the commission required to refund the net assessment collected.

The one dollar per animal assessment expires when the attorney general certifies that the federal assessment amount has increased beyond the amount in effect on July 31, 2015.
