HB 1316 Summary

• School district boards must conduct a formative evaluation of superintendents on or before November 15 and a formal second evaluation on or before March 15 each year.

• Evaluation reports must be provided to the superintendent and placed in their personnel file, with the superintendent permitted to submit a written response.

• Individuals employed as both principal and superintendent must be treated as superintendents for all purposes related to evaluation, discharge, and nonrenewal.

• Superintendents, principals, assistant superintendents, and associate superintendents employed for less than two years must receive written notice of nonrenewal before May 1, with an optional executive session to discuss reasons.

• Communications made in executive sessions regarding nonrenewal notifications are protected from libel and slander claims.
