School boards must consist of three, five, seven, or nine members, with size changes requiring a petition signed by at least one-third of voters from the most recent election and majority approval at a special election.

When a board increases in size, new members are elected at the next annual election with staggered initial terms determined by lot: for a five-member board, terms extend one, two, and three years; for seven members, terms extend one, two, two, and three years; for nine members, terms extend one, two, two, three, three, and three years.

Existing terms of current board members cannot be modified when the board size increases.

Board size reductions must occur at the conclusion of existing terms.

The Fargo city school board is exempt from these provisions and consists of nine members.
