HB 1385 Summary

• Adds definitions for "internet protocol-enabled service" (any service using internet protocol enabling end users to send or receive voice, data, or video communication) and "voice over internet protocol service" (real-time, two-way voice communication over internet protocol using broadband connection with ability to send and receive calls to/from the public switched telephone network).

• Prohibits state entities and political subdivisions from regulating entry, rates, terms, or conditions for internet protocol-enabled or voice over internet protocol services through rules, orders, or other means.

• Makes voice over internet protocol service subject to state high-cost universal service fund assessments, 911/E911 fees, required surcharges under section 54-44.8-08, and taxes under chapter 57-34.

• Preserves existing regulatory authority over wholesale tariffs, federal Communications Act obligations, intrastate switched access rates, video/cable service obligations, essential telecommunications services, federal universal service fund issues, zoning powers, consumer protection laws, and chapter 49-23 obligations.
