The North Dakota legislative assembly or designated official must certify all delegates and alternate delegates to any Article V constitutional convention and provide written certification to each delegate and to the convention.

All delegates and alternate delegates must execute an oath swearing to support the U.S. and North Dakota constitutions and pledging not to vote on any "unauthorized amendment" proposed for ratification.

An "unauthorized amendment" is defined as any proposed amendment that varies from the exact text contained in the legislative assembly's application or, if no application was made, the exact text relied upon by Congress in calling the convention; or any amendment outside the permitted subject matter specified in applications.

The legislative assembly must provide guidance to delegates upon request regarding whether a proposed amendment falls within the convention's permitted subject matter.

Any delegate casting or attempting to cast a vote in violation of these restrictions must be immediately rendered ineligible, removed from office, and replaced by an alternate delegate; any such vote is declared void.
