Amends North Dakota Century Code section 32-03-09.1 to clarify the measure of damages for property injury caused by breach of non-contractual obligations.

Establishes that damages are presumed to be the reasonable cost of repairs to restore property to pre-injury condition, plus reasonable loss of use value during restoration.

Provides alternative damages measure (difference in market value before and after injury, plus loss of use) when property restoration within a reasonable timeframe is impossible or impracticable.

Defines property restoration as impracticable when the combined cost of repairs and loss of use exceeds the market value diminishment and replacement loss of use.
