Amends North Dakota Century Code section 19-03.4-03 to restructure penalties for unlawful possession of drug paraphernalia into four distinct subsections based on the type of controlled substance and intended use.

Establishes class C felony penalty for using or possessing drug paraphernalia to manufacture, compound, convert, produce, process, prepare, test, inject, ingest, inhale, or analyze controlled substances other than marijuana in schedules I, II, or III.

Establishes class A misdemeanor penalty for using or possessing drug paraphernalia to inject, ingest, inhale, or otherwise introduce controlled substances other than marijuana in schedules I, II, or III, escalating to class C felony upon prior conviction of non-marijuana drug offenses.

Establishes class A misdemeanor penalty for using or possessing drug paraphernalia to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, or conceal marijuana.

Establishes class B misdemeanor penalty for using or possessing drug paraphernalia to ingest, inhale, or otherwise introduce marijuana into the human body.
