Creates new eligibility exception allowing individuals to apply for the service payments for elderly and disabled program without first applying for services under chapter 50-24.1 if their estimated monthly benefits fall between specified income levels or if they receive services unavailable under chapter 50-24.1

Requires home and community-based services case managers to notify the state agency when using the new eligibility exception

Prohibits the department from filing claims against estates to recover medicaid payments made on behalf of recipients who received coverage through a private carrier

Maintains existing protections preventing claims from being required during the lifetime of a decedent's surviving spouse or while a surviving child under age 21 is alive, or if the child is blind or permanently and totally disabled
