Department of Corrections and Rehabilitation may establish a pretrial services program pilot project in one or more judicial districts during the biennium from July 1, 2015, through June 30, 2017.

Probation and parole officers shall supervise individuals charged with felonies and class A misdemeanors involving violence or intimidation (assault, harassment, stalking, domestic violence restraining order violations, disorderly conduct restraining order violations) who are on pretrial release.

Department and judiciary shall collaborate to develop guidelines including conducting actuarial risk assessments, investigations of criminal history and community ties, making pretrial release recommendations, monitoring compliance, and reporting violations to district courts.

Probation and parole officers or law enforcement may take individuals into custody if there is probable cause they violated pretrial release conditions or when directed by district court, with hearings conducted on alleged violations.

Department and judiciary shall report to the Sixty-fifth Legislative Assembly on process measures, outcome measures, and performance of the pretrial services pilot project.
