Senate Bill 2145 Summary

• Amends North Dakota Century Code section 12-60-24 to authorize the Bureau of Criminal Investigation to provide statewide and nationwide criminal history record checks to specified state agencies, officials, and entities.

• Expands the list of entities authorized to request criminal history checks, adding new recipients including the insurance department, state board of respiratory care, board of counselor examiners, real estate appraiser board, and workforce safety and insurance.

• Requires public school districts, multidistrict special education units, area career and technology centers, regional education associations, and nonpublic schools to pay the costs associated with obtaining criminal history record checks for employees and final applicants with unsupervised student contact.

• Defines "unsupervised contact" with students as being in proximity to one or more students on school grounds or at school functions outside the presence of an individual who has been subject to a criminal history record check.

• Passed the Senate 47-0 and the House 87-1 in the 2015 regular session.
