State Department of Health shall establish and administer an autism spectrum disorder database containing all reported cases of autism spectrum disorder in North Dakota to enable epidemiologic surveys, research, and service provision.

Reporters must be physicians, psychologists, or other licensed or certified health care professionals qualified by training and licensure or certification to diagnose autism spectrum disorder.

Database records must include diagnoses under the most recent edition of the American Psychiatric Association's Diagnostic and Statistical Manual of Mental Disorders and indicate whether a complete physical evaluation by a licensed independent practitioner was performed as part of the diagnostic process.

Health Council shall adopt rules requiring mandatory reporting to the database and establishing reporting requirements including timeliness requirements.

State Department of Health shall maintain database records as confidential but may share them with other state agencies as necessary to effect the purposes of the database, with receiving agencies required to maintain confidentiality.
