Board may suspend, refuse to renew, or revoke the certificate of registration of professional engineers and land surveyors, or reprimand any registrant found guilty of fraud, deceit, gross negligence, incompetence, misconduct, or violation of the code of ethics.

If disciplinary action is imposed, the board may direct a registrant to pay reasonable and actual costs, including reasonable attorney's fees, incurred in investigation and prosecution of the case.

If a registrant prevails in an administrative appeal of a disciplinary action, the board shall pay the registrant's reasonable and actual costs, including reasonable attorney's fees.

All charges must be heard by the board within six months of filing unless the accused registrant waives this requirement, and the accused has the right to appear in person or by counsel, cross-examine witnesses, and produce evidence in defense.

Board members who did not serve on the investigative panel must deliberate in executive session, and a majority vote is required to sustain charges before the board issues findings of fact, conclusions of law, and its order.
