Amends Section 38-08-04.5 of the North Dakota Century Code to govern the abandoned oil and gas well plugging and site reclamation fund.

Fund revenue sources include permit fees, forfeited drilling bonds, federal moneys, donations, oil and gas impact fund moneys, civil penalties under Section 38-08-16, and proceeds from sale of confiscated equipment.

Fund may be used for plugging abandoned wells, reclamating drilling and production sites, paying mineral owner royalties from confiscated oil, and defraying pipeline reclamation costs.

Fund moneys may be transferred to the environmental quality restoration fund for the state department of health to address environmental emergencies related to oil and gas development, including oilfield waste disposal and rail, road, or pipeline transportation issues.

Industrial commission must report to the legislative management budget section each biennium on fund balance and expenditures.
