Amends North Dakota Century Code sections 49-23-01 and 49-23-05 regarding excavation site marking materials and their removal.

Adds definition of "tangible marking materials" as physical materials perceptible by touch used to mark underground facilities, including flags, stakes, and poles, but excluding paint, chalk, and liquid ink-based materials.

Modifies operator responsibilities to require removal of all tangible marking materials used to mark facilities upon completion of excavation, changing language from "when possible" to "upon completion."

Reorganizes and renumbers existing definitions in section 49-23-01 to incorporate the new tangible marking materials definition.
