Reorganizes the health information technology advisory committee to include specified state officials and governor-appointed stakeholders, with provisions for mileage, expenses, and salary compensation based on member status.

Moves health information technology loan program authority from section 6-09-42 to section 54-59-26, allowing the health information technology office director to establish loan and planning loan programs for health care providers to purchase electronic health record technology and related infrastructure.

Requires the health information technology office to adopt rules for health information exchange access, usage, fees, and participation eligibility, with criteria aligned to federal requirements and state health information technology plans.

Designates all individually identifiable health information submitted to or stored in the health information exchange as exempt records under North Dakota open records law unless otherwise confidential under federal or state law.

Repeals section 6-09-42 of the North Dakota Century Code as the health information technology loan program provisions are consolidated into chapter 54-59.
