Amends North Dakota Century Code sections 50-06.2-10 and 50-24.7-02 to clarify overpayment recovery procedures for the service payments for elderly and disabled program and the expanded service payments for elderly and disabled program.

Allows the state agency to recover overpayments resulting from concealment, misrepresentation, fraud, or assistance granted pending appeal decisions, regardless of when the overpayment occurred.

Permits overpayment collection from any person who benefited from or was responsible for the overpayment, eliminating statutes of limitations and the doctrine of laches as defenses.

Requires home and community-based services case managers to notify the state agency when using exceptions to the standard application requirements for eligible individuals.

Passed with overwhelming House support (94-0) and strong Senate support (44-3).
