Class A commercial driver's license holders are exempted from the hazardous materials endorsement when employed by custom harvesters, agrichemical businesses, farm retail outlets and suppliers, or livestock feeders, and operating within their state of domicile or another state with a hazardous materials enforcement exemption.

The exemption applies only when operating a service vehicle transporting diesel in quantities of 1,000 gallons (3,785 liters) or less.

Vehicles transporting diesel under this exemption must be clearly marked with either a "flammable" or "combustible" placard as appropriate.

The exemption is limited by 49 Code of Federal Regulations part 383.3.

The act is declared an emergency measure.
