Amends subsection 2 of section 15.1-36-01 of the North Dakota Century Code regarding superintendent approval of school construction projects.

Requires school districts to demonstrate project need, educational utility, or potential utilization by a future reorganized school district.

Mandates districts show either stable or increasing student population over the preceding five school years and expected stability or increase over the ensuing five school years, or demonstrate by clear and convincing evidence that no feasible alternatives exist despite declining enrollment.

Requires districts to demonstrate capacity to pay for the project under superintendent-adopted rules and prohibits funding the project through expenditure of ending balance funds intended for operational costs.
